This should be interesting, if not ground breaking. In what is believed to be the first of its kind in this country, a Tampa doctor is on trial for “drug trafficking” for, essentially, prescribing unnecessary pain medications in “bad faith.” The link below gives the full text of the St. Petersburg Times article that is following the trial, which began yesterday.
Dr. John Mubang of Tampa is the accused doctor. In 2008 two undercover detectives went to Dr. Bordano’s office on multiple occasions. They told the office staff that they had suffered injuries in motor vehicle accidents and were in pain. After Dr. Mubang examined them, they received prescriptions for Vicodin, Robaxin, Xanax, and Percocet. The prosecution claims that the pain medications were unnecessary and “over prescribed.”
Frankly, this sounds like a difficult case to prosecute. Dr. Mubang appears to have been in practice for years with an unblemished medical license and no criminal history. The detectives told the doctor about pain complaints and automobile accidents. A strong defense argument can be made that Dr. Mubang relied on what his “patients” were telling him and conducted a physical examination before he prescribed the medications is question. Additionally, for every medical professional that says that Dr. Mubang “over prescribed” the pain medications, there will be another that will say his medical decisions regarding medications were appropriate.
